Child Support that follows the foster care model of parent sustainability

  1. Custody
    1. With the implementation of child support is the automatic attachment of joint custody
    2. Custody is non-contestable
      1. Cases in which child’s safety risk is high with a parent are provided supports for 6 months while state retains joint custody extended as needed until parent can assume custody.
    3. Alternating visitation is required
  2. Monetary Responsibility
    1. State Responsibility
      1. State will provide 20% of gross reported income monthly
      2. If unemployed, state will provide temporary supports
        1. Monthly $1000 stipend regardless of household size for 6 mos. to be extended on case-by-case basis with proof of job search and training
        2. Training for entrepreneurship or employable skills
      3. State will provide food stamps based on household occupancy and income
      4. State will provide childcare stipend based on household occupancy and income
    2. Parent Responsibility (Both mother and father)
      1. Full time employment is required
      2. If unemployed, registration in trainings and providing weekly job searches of gainful employment to meet 6-month deadline
  3. Childcare Responsibility of both parents
    1. Each parent is required to provide space for their child in their current living situation.
      1. Child must have their own room or share a room with another child only.
      2. Parent must have their own separate sleeping quarters.
    2. Each parent is required to provide for their child’s basic needs  within their current living situation.
  4. Disciplinary Action
    1. Lack of fulfillment of preparation tasks remits case to CPS with neglect charges punishable by CPS monitoring.
    2. Lack of fulfillment of employment after 2 extensions due to noncompliance remits case to CPS for neglect charges punishable by CPS monitoring.
    3. Lack of providing a livable space for child within current residence remits the case to CPS with charges of neglect punishable by CPS monitoring.
    4. Lack of maintaining basic needs of the child remits the case to CPS with charges of neglect punishable by CPS monitoring.
    5. Lack of maintaining visitation between both parents remits the case to family court under the following allocation:
      1. Charges of neglect for failure to receive the child punishable by CPS monitoring
      2. Charges of contempt of court for failure to deliver the child punishable by CPS monitoring

 

Should the neglect continue or harm come to the child(ren) while under monitoring, the parent then can be criminally charged. This decreases the instances of mental or emotional abuse on the family members and provides the support needed for the family to continue to support the child from both parents.
